At any moment and for any reason, X-Byte Analytics has the right to deny Service to anybody.

Data provided by X-Byte Analytics will not have its copyright owner or entity verified. Your use of the data is entirely your responsibility. You pledge to use the content lawfully and by all current copyright regulations. X-Byte Analytics disclaims all liability for any legal disputes brought on by your improper use of the supplied information.

With your consent, X-Byte Analytics may use a few third-party tools to fulfill your service requirements. Such third-party tools won’t be controlled or monitored in any way. You understand and recognize that X-Byte Analytics is not liable for any problems with any third-party tools we integrate with our services or products. Your use of optional third-party tools is not subject to any liability on our side.

Privacy

Our concern for user privacy is excellent. Please take the time to carefully read our Privacy Policy, which is available at Privacy Policy, for information on how we collect, use, and disclose your personal information.

Acceptance of Listing as a Customer

By utilizing the Services, you grant X-Byte Analytics permission to use your name, brand name, and logo to publish a clientele list for marketing purposes.

Termination

Terminating this Agreement shall not affect the parties’ responsibilities or liabilities accrued before the termination date. Unless and until either party terminates them, these terms of Service remain in force. By telling us that you no longer want to use our services or by stopping your usage of our website, the User may terminate the Terms of the Services at any time. If, in our sole judgment, you have failed to comply with any term or condition of these Terms of Service, or if we have reasonable grounds to suspect that you have failed to comply, we may terminate the Agreement immediately and without notice. The User will remain responsible for any monies owed until the termination date.

Terms of Payment; Fees and Taxes

You are accountable for promptly using a legitimate payment method to pay any relevant fees as stated on the price and payment conditions supplied to you and accepted by you at the time of your order, such as in an email order or invoice, and any applicable taxes related to the Service. You consent to us charging your chosen payment method for additional due costs.

User Information

X-Byte Analytics shall not have the right to resell User Data. However, you agree that X-Byte Analytics may use data obtained from User Data for running, analyzing, enhancing, or marketing the Service and any connected services. Suppose X-Byte Analytics distributes or publicly reveals information generated from User Data. In that case, the information will be aggregated to prevent tying the information back to the User or a specific person.

You must affirm, warrant, and agree to the following:

  • You have lawfully obtained the User Data.
  • X-Byte Analytics does not take responsibility for any User Data.
  • You will be solely responsible for your User Data and the results of sharing or disclosing it hereunder, including X-Byte Analytics’ use of such User Data as contemplated herein.
You are entirely responsible for regularly backing up your User Data and taking the necessary precautions to protect and maintain its integrity
X-Byte Analytics may automatically retrieve data from your system(s) or third-party systems/services/sites. By indicating this within your User Account, you now represent and warrant that you have the permission, authority, and rights to use the Service to access and allow X-Byte Analytics to automatically access such system(s)/services/sites and retrieve User Data. You acknowledge that using the Service won’t violate any agreements, terms of Service, privacy policies, or implicit promises by third parties.
Your User Data is yours; you have all legal ownership rights, including all intellectual property rights.
 

API Usage

To allow clients to access our services programmatically, X-Byte Analytics offers API as one of the delivery methods. The exact terms and conditions listed on this page apply to the usage of API, which is a component of the services offered by X-Byte Analytics. You acknowledge that you are responsible for exercising reasonable good faith efforts to prevent any prohibited uses under these Terms of Exercise from occurring when others use any tools or software you develop that utilizes the X-Byte Analytics. As long as neither party terminates the Service, you may utilize the API.
 

Ownership; Exclusive Rights

X-Byte Analytics is the owner and operator of the Service. The services offered by Xbyte Analytics include software, API, visual interfaces, graphics, design, compilation, information, and computer code. All trade names, trademarks, and service marks are the exclusive property of X-Byte Analytics or its affiliates.
 

Warranty

X-Byte Analytics makes no representation, warranty, or guarantee regarding the appropriateness, truth, availability, accuracy, or completeness of any Content or the services unless otherwise mentioned in these Terms.

Indemnification

You acknowledge that you are responsible for protecting X-Byte and all of its affiliates, directors, officers, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your violation of these Terms of Service or any applicable law.
 

Miscellaneous

Waiver

No right or provision of these Terms will be waived by X-Byte’s Analytics’ failure to assert or enforce such right or provision. Any waiver of any term of these terms must be in writing and signed by X-Byte Analytics to be valid.

Severability

The enforceability or invalidity of one or more of this Agreement’s clauses shall not affect the legality or enforceability of the other clauses. Any unenforceable or invalid clause in this Agreement must, to the extent practicable, be amended to reflect the original purpose of the parties.
 

Assignment

All changes will be made if both parties agree to them in writing and sign them. This is the complete Agreement between you and X-Byte Analytics about the subject matter.
 

Rule of Law

The laws of India shall govern this Agreement, and Ahmedabad, Gujarat will have jurisdiction over it.
 

Refund Procedure

If you have any concerns about the delivery, bring them up with the project coordinator and the designated technical lead. Please tell your Business Development team account manager if the problem still needs to be fixed. The account manager for concerns will undoubtedly take the necessary action to address any of your concerns.
 
Email us at sales@xbyte.io if your account manager doesn’t handle your complaint. Following receipt of your complaint’s specifics, Management will decide whether to issue you a full or partial refund at its discretion.
 
We kindly ask customers to request a refund and specify their inconvenience. That will allow us to improve our product and, if necessary, deal with any bottlenecks or other issues.
